Virtual Office Website (VOW) Terms of Use

About This Website

NickLists.com is a Virtual Office Website (VOW) operated by Nick Kalra, Sales Representative, HomeLife/Miracle Realty Ltd., Brokerage, a member of the Toronto Regional Real Estate Board (TRREB) / PropTx MLS® System. This VOW provides registered consumers with access to MLS® listing data, including information not available on public displays.

These terms may be updated from time to time. Material updates will require you to re-acknowledge your agreement before continued access to VOW-restricted data.

What Is VOW Data?

VOW Data includes listing information that is restricted to registered users under TRREB/PropTx rules. This includes:

• Sold and leased prices;
• Days on Market (DOM);
• Original listing date;
• Full listing history for a property address;
• Conditionally sold / conditionally leased status;
• Any other data designated as restricted by TRREB or PropTx.

Publicly active listings (IDX data) are available without registration. VOW Data is only accessible after creating a verified account and agreeing to these terms.

Registration Requirements

To access VOW-restricted content you must provide your full name and a valid email address. A confirmation email will be sent to verify your agreement to these Terms of Use. Access is only permitted after email verification is complete.

Your account credentials are personal to you and valid for up to 90 days, after which you must renew your password to maintain access. You must not share your credentials with any other person.

Terms of Use Agreement

By registering and accessing this VOW you acknowledge and agree to all of the following:

(i) Broker–Consumer Relationship

You acknowledge that you are entering into a lawful broker–consumer relationship with Nick Kalra, Sales Representative, HomeLife/Miracle Realty Ltd., Brokerage.

(ii) Personal, Non-Commercial Use Only

All MLS® data obtained from this VOW is for your personal, non-commercial use only. You may not use it for any business, investment analysis, or other commercial purpose.

(iii) Bona Fide Interest

You confirm that you have a bona fide interest in the purchase, sale, or lease of real estate being offered through this VOW.

(iv) No Redistribution

You will not copy, redistribute, retransmit, or otherwise use the listing data except in connection with your personal consideration of an individual property purchase, sale, or lease.

(v) PropTx Ownership and Copyright

You acknowledge PropTx's ownership of and copyright in the MLS® database, MLS® data, PropTx's MLS® System, and all Listing Information displayed on this website. The trademarks MLS®, Multiple Listing Service®, and the associated logos are owned by The Canadian Real Estate Association (CREA).

(vi) Prohibited Uses

You will not display, post, disseminate, distribute, publish, broadcast, transfer, sell, or sublicense any Listing Information. Prohibited uses expressly include:

• Screen scraping or database scraping;
• Data mining or automated data collection of any kind;
• Any activity to collect, store, re-organize, summarize, or manipulate Listing Information;
• Building or contributing to any competing database of listing data.

(vii) Compliance Monitoring

You expressly authorize PropTx and other PropTx Members, or their duly authorized representatives, to access this VOW for compliance verification and monitoring purposes.

Audit Logging

Access to VOW-restricted fields is logged. Records may include the timestamp, IP address, listing identifier, and user account associated with each access. These records are retained in accordance with TRREB/PropTx requirements and may be disclosed to regulatory authorities upon lawful request.

Accuracy Disclaimer

Listing data is sourced from the TRREB/PropTx MLS® System and is deemed reliable but is not guaranteed to be accurate. All measurements, sizes, prices, and descriptions should be independently verified through a licensed real estate professional before relying on them. NickLists.com and Nick Kalra, Sales Representative, assume no liability for errors or omissions in the data.

Privacy

Your personal information (name, email address, phone number, account credentials) is collected and used to provide you with access to this VOW. Your information may be shared with PropTx for auditing and/or legal purposes as required under PropTx's VOW Policy and Rules. We comply with all applicable privacy legislation including PIPEDA.

Withdrawal of Consent

You may withdraw your consent to access VOW-restricted data at any time by emailing nick@nickkalra.com. Upon withdrawal, VOW Data fields will no longer be displayed to your account. Audit records of prior access are preserved as required. You may re-enable VOW access at any time by contacting us.

Account Suspension

We reserve the right to suspend or terminate your access at any time if we reasonably believe you have violated these Terms of Use or are misusing listing data. Records of your registration may be retained for not less than 180 days after your password expires and provided to PropTx upon request if a security breach is suspected.
